1. PARTIES AND ACCEPTANCE

1.1. These Terms and Conditions (“Terms”) govern your access to and use of the website www.jensballoons.net (the “Site”), as well as the engagement of the services offered on it.
1.2. The Site is operated by Jen’s Balloons (“Jen’s,” “we,” “us,” or “our”), with services provided in Columbia and Lexington, South Carolina.
1.3. By browsing, registering, requesting services, or making purchases on the Site, you accept these Terms in full. If you do not agree, please do not use the Site or engage our services.

2. PURPOSE

2.1. Jen’s Balloons specializes in creating balloon décor for all kinds of celebrations—birthdays, weddings, corporate events, and more. We offer, among others:

Balloon walls and backdrops

Garlands / balloon garlands

Balloon columns and towers

Balloon bouquets (including “flower balloon bouquets” and “bubble balloon bouquets”)
2.2. Through the “Shop Online” section, you can purchase predefined arrangements and décor kits.

3. BOOKING AND PURCHASE PROCESS

3.1. To request a quote or book a service, complete the “Inquire Now” form on the Site or email [email protected].
3.2. After receiving your request, we will send a detailed proposal with product descriptions, timelines, and costs.
3.3. The booking is confirmed once the deposit indicated in the proposal is paid (generally 50% of the total).

4. PRICING AND PAYMENT METHODS

4.1. All listed or quoted prices are in U.S. dollars (USD) and exclude taxes unless otherwise specified.
4.2. We accept payment by credit/debit card or bank transfer. Card charges are processed through secure gateways.
4.3. We reserve the right to adjust prices without prior notice, except for bookings already confirmed.

5. DELIVERY AND INSTALLATION TIMEFRAMES

5.1. Setup and delivery timeframes vary depending on the complexity of the design and the event date; they will be agreed upon when the order is confirmed.
5.2. For date changes or cancellations, see Section 6.

6. CANCELLATIONS AND REFUNDS

6.1. If you need to cancel or reschedule your order, please notify us at least 48 hours before the agreed date and time.
6.2. Cancellations made more than 48 hours in advance are eligible for a refund of 50% of the deposit.
6.3. Cancellations made less than 48 hours in advance result in full forfeiture of the deposit.

7. CLIENT OBLIGATIONS

7.1. You must provide accurate information about the address, schedule, and characteristics of the setup location.
7.2. The client is responsible for ensuring the access and space required for installation.
7.3. Altering or damaging the décor before pickup is prohibited; any damage attributable to the client will incur additional charges.

8. INTELLECTUAL PROPERTY

8.1. All intellectual and industrial property rights over the Site’s content (design, texts, images, trademarks, and code) belong to Jen’s Balloons or authorized third parties.
8.2. Reproduction, distribution, dissemination, or any other form of exploitation without prior written authorization is prohibited.

9. DISCLAIMER OF WARRANTIES AND LIABILITY

9.1. The Site and services are provided “as is” and “as available.” Jen’s does not warrant that the Site will be error-free or uninterrupted.
9.2. Jen’s is not liable for indirect, special, or consequential damages (loss of income, data, reputation, etc.) arising from the use of the Site or the engagement of services.
9.3. Jen’s total liability for any claim will not exceed the total amount paid by the client for the corresponding service.

10. LINKS TO THIRD-PARTY SITES

10.1. The Site may contain links to third-party pages for your convenience. We are not responsible for the content or policies of those sites.

11. CHANGES TO THE TERMS

11.1. We may update these Terms at any time.
11.2. We will publish the “Last updated” date at the beginning of this document. Your continued use after changes implies acceptance of the new conditions.

12. SUSPENSION AND TERMINATION

12.1. We may suspend or terminate your account and access to the Site in case of breach of these Terms or misconduct.
12.2. The provisions that by their nature should survive will remain in force after termination (intellectual property, limitation of liability, governing law).

13. GOVERNING LAW AND JURISDICTION

13.1. These Terms are governed by the laws of the State of South Carolina, U.S.A.
13.2. For any dispute arising from these Terms, the parties submit to the jurisdiction of the competent courts of Columbia or Lexington, South Carolina.
